As a property owner in Florida, you’re likely aware of the many advantages of going solar in the Sunshine State. Yet, if your residence is controlled by an HOA, you may be wondering how much of a say your HOA has on installing panels on your home.
Luckily, there are Florida laws that protect your right to install solar panels. Understanding your rights regarding residential solar panel installation and exactly how much control your HOA has can help you successfully gain the benefits of going solar.
Can HOA Deny Solar Panels in Florida?
No. Florida Statute 163.04 states that no binding agreement (including HOA agreements) can prohibit a property owner from installing solar panels or any other energy devices based on renewable resources.
To join a planned community, residents agree to abide by certain HOA conditions and restrictions. These regulations often place limits on how you can alter the building or surrounding landscape. Statute 163.04 clarifies that agreements used to “approve, forbid, control, or direct alteration of property with respect to residential dwellings and within the boundaries of a condominium unit” cannot deny a property owner permission to install solar collectors.
What Actions Can HOAs Take?
While your HOA can’t deny your right to install solar panels, they can maintain some control over the installation placement and process.
Solar Panel Placement
Subsection 2 of Statute 163.04 says that an HOA can determine the specific location of your solar panels, but only if the determination doesn’t impair their effectiveness. Solar panels work best on a south-facing roof but are still 80%-85% effective when installed on an east/west roof in ideal conditions. Your HOA can choose the location of your panels as long as their orientation remains to the south or within 45° east or west of due south.
Installation Process
Since many HOA regulations are designed to promote safety, your HOA may also require specific procedures for installing solar panels. For example, an inexperienced homeowner attempting a DIY solar panel installation might not have the experience of setting up proper connections and safety measures. Installations that don’t comply with residential building codes may result in fines and requirements to repair or redo the entire installation.
Tips for Successfully Installing Solar Panels When You Live in an HOA
While living in an HOA may require you to abide by certain restrictions, it doesn’t limit your rights to the benefits of using solar panels. These tips can help you achieve a successful solar panel installation while complying with HOA regulations.
- Install solar panels in your yard rather than on your roof to help avoid changing the appearance of your home.
- Use materials that match the color of your roof for a more subtle appearance.
- Meet with your HOA board before installation to overcome any objections.
- Install your solar panels with a reputable solar installation company.
- Offset the costs of professional installation and meeting HOA demands by seeking state and federal incentives.
